Site Map of MN-DWI.COM

Here's a summary of what's on my pages here at mn-dwi.com:

  • Home page where I list a few of the things I can do for you if you hire me.

  • Contact.  How to contact attorney David Kelly.  Address, phone numbers, email address, hours of operation.

  • Law and Comment page, where I discuss problems and penalties of the first, second, third and fourth offense;which arrests result in misdemeanor, gross misdemeanor and felony.  How the time between arrests can make a big difference.

  • First Arrest First Aid, some dos and don'ts in the event that you get stopped for DWI.  How to act if it is your first arrest, and what to expect if it's your second or more in ten years.

  • .08 Questions and Answers.  FAQs concerning the reduction of the legal limit from .10 to .08.  Why the law was changed, how many drinks are legal under the new standard, whether the lower limit increases safety.

  • License Plate and Vehicle Seizure Law.  How the state will take your plates upon the second arrest in ten years, and how after that, or if your reading is over .20 at the time of the second arrest, they will take your car.  Specail "Whisky" plates explained.

  • Estimating table for women.  Table showing on average what the levels of alcohol will be in a woman's blood based on body weight and number of drinks.

  • Estimating table for men.  Table showing on average what a man's blood alcohol level should be based upon weight and number of drinks.   These tables are based on averages, and are not necessarily exactly how your body will react.

  • Limited license waiting periods.  Recently checked again for accuracy, this table shows how long a DWI arrestee has to wait before being eligible for a limited to drive to and from work or school.

  • DWI Test and Alcohol Assessment.  Separate but related processes:  the testing and interviewing that is required after arrest for reinstatement of driver's license and to satisfy court requirements that a counseling professional evaluate the extent that drinking has become a problem.  What to study and what questions to expect.

  • Underage Drinking and Driving.  Maddening and often misunderstood laws, rules and regulations for the under age 21 or under age 18 driver who has consumed alcohol.

  • Handouts page, a small gold mine of information.  See Anoka and Ramsey County's handouts for their programs where first offenders are sent for education or rehab; or check out Hennepin County's Probation Department's list of where to go for an alcohol assessment or an alcohol information class.  Look at a two page summary from Minnesota's Department of Public Safety listing every alcohol-related driving offense there is, along with the maximum penalties and the driver license consequesnces.  Or review a sentencing and charging cheat sheet we stole from one of the suburban prosecutors (well, they left it on the table in the courtroom). Find inspiration in a state handout lising all the hoops that must be jumped if you hope to ever drive again after being classified as "inimical to public safety."

  • Snomobiles, boats, all terrain vehicles.  If you are operating it in the State of Minnesota, and it has a motor, chances are it's a motor vehicle; and if you have been drinking, you can get a DWI for using it.  This includes your riding lawn mower.  If it should be a boat, snowmobile or ATV, however, the State gives a bit of a break if it's only a first offense.

  • About Dave Kelly.  More than you probably want to know about the my life and times.  Links to the ratings provided by other lawyers and by a few clients.
  • Directions.  A map and directions showing how to find my office.

  • DWI Directory.  A nation-wide listing of other DWI defense lawyers.  You should be able to find a good DWI lawyer here for every major city in the country.
